Terms of Service

1. Who you are contracting with

These Terms of Service ("Terms") are a binding agreement between you and Maatha.ai ("Maatha.ai", "we", "us"), the provider of the Maatha.ai website, applications and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms.

2. The Service

Maatha.ai generates personalized early-learning lessons, including narrated story slideshows, from photos and information you provide. Features may evolve over time.

3. Eligibility and account

You must be of legal age in your jurisdiction (and, where you act on behalf of an organization, you must have authority to bind it). You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and to keep it up to date.

4. Acceptable use

You agree not to misuse the Service. In particular, you will not:

  • use the Service for unlawful, fraudulent, deceptive, or harmful purposes;
  • upload content you do not have the right to use, including photos of people who have not consented to appear in lessons;
  • upload content that is illegal, sexually explicit, hateful, harassing, or that depicts the abuse or sexualization of minors;
  • infringe intellectual property or privacy rights of others;
  • send spam or attempt to interfere with the security or integrity of the Service (malware, probing, scraping, denial-of-service, circumvention of rate or technical limits);
  • reverse engineer, resell, or redistribute the Service, except as expressly permitted by law.

5. Your content

You retain ownership of the photos and information you upload ("User Content"). You grant Maatha.ai a limited, worldwide, non-exclusive license to host, process, transmit, and adapt your User Content solely to provide and improve the Service for you. We do not sell your User Content, we do not use it to train third-party AI foundation models, and we do not share it with advertisers.

6. AI-generated outputs

Lessons, narrations and images generated by the Service are produced by AI systems. While we work to make outputs warm, accurate and age-appropriate, AI outputs can occasionally contain errors or unexpected results. You are responsible for reviewing generated content before sharing it with your child. The Service is not a substitute for professional educational, medical, psychological or legal advice.

7. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by Maatha.ai and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your subscription plan.

8. Subscriptions, payments, and refunds

Paid plans are billed in advance on a recurring basis (monthly or annually) until you cancel. By subscribing, you authorize our payment processor to charge your payment method on each renewal until you cancel. You can manage or cancel your subscription at any time from the customer portal linked in your dashboard. See also our Refund Policy.

9. Service availability

We work hard to keep the Service running, but we do not guarantee that the Service will be uninterrupted, error-free, or available at all times. The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Maatha.ai will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities. Our aggregate liability arising out of or relating to the Service is limited to the amounts you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law (such as fraud, death, or personal injury caused by negligence).

11. Indemnity

You agree to indemnify and hold Maatha.ai harmless from claims, damages, liabilities, and expenses arising out of your User Content, your use of the Service in breach of these Terms, or your violation of applicable law or third-party rights.

12. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, if your payment is overdue, if we reasonably suspect fraud or security risk, or if you repeatedly or seriously violate our policies. You may stop using and cancel the Service at any time via the customer portal linked in your dashboard or by contacting us.

13. Consequences of termination

On termination, your right to access the Service ends. We may delete your account and User Content after a reasonable period, except where retention is required by law.

14. Changes

We may update these Terms from time to time. If changes are material, we will provide reasonable notice (for example, by email or in the Service). Continued use of the Service after changes take effect constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which Maatha.ai operates, without regard to conflict of law principles. Subject to mandatory consumer protection laws of your country of residence, the courts of that jurisdiction will have exclusive jurisdiction over disputes.

16. Miscellaneous

You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets. If any provision is held unenforceable, the remaining provisions will remain in effect. Neither party is liable for delays caused by events beyond reasonable control (force majeure).
